Terms of Service

Last updated: August 18, 2026. By purchasing, accessing, registering for, or using any Service provided by Zenithz Cloud, you confirm that you have read, understood, and agreed to these Terms.

Introduction

These Terms of Service ("Terms", "Agreement", "Terms of Service") govern your access to and use of the hosting services, websites, control panels, infrastructure, software, and related services ("Services") provided by Zenithz Cloud ("Zenithz Cloud", "we", "us", or "our").

By purchasing, accessing, registering for, or using any Service provided by Zenithz Cloud, you confirm that you have read, understood, and agreed to these Terms. If you do not agree with any part of these Terms, you must not use our Services.

These Terms apply to all customers, users, accounts, organizations, servers, virtual machines, game servers, storage, network services, APIs, control panels, and other resources provided by Zenithz Cloud unless a separate written agreement explicitly states otherwise.

1. Definitions

For the purposes of these Terms:

2. Eligibility

You must have the legal capacity required to enter into a binding agreement under applicable law.

If you are under the legal age required to independently enter into contracts in your jurisdiction, you may only use the Services with the permission and involvement of a parent, guardian, or other legally authorized person where required.

You are responsible for ensuring that your use of the Services complies with the laws applicable to you.

We reserve the right to request reasonable verification information where necessary to prevent fraud, abuse, or unauthorized use.

3. Account Registration

You may be required to create an account to access certain Services.

You agree to provide accurate and current information during registration and to keep that information updated.

You are responsible for: • Maintaining the confidentiality of your account credentials. • Protecting passwords, API keys, tokens, SSH keys, and authentication methods. • All activity performed through your account. • Immediately notifying us of suspected unauthorized access. • Ensuring that your account is not shared in a manner that creates a security risk.

You must not intentionally provide false, misleading, fraudulent, or impersonated information.

We may restrict or terminate accounts created using fraudulent information.

4. Account Security

You are responsible for securing your account.

Zenithz Cloud will not be responsible for losses resulting from: • Weak passwords. • Password reuse. • Credential sharing. • Exposed API keys. • Compromised SSH credentials. • Malware installed on your server. • Unauthorized access caused by customer negligence. • Credentials stored publicly or in unsecured software repositories.

You should enable all available security features, including multi-factor authentication where supported.

If you believe your account has been compromised, you must contact us immediately.

5. Services

Specific resources, features, locations, pricing, and limitations may vary between products.

We reserve the right to modify, replace, discontinue, or introduce Services, provided that such changes do not unlawfully deprive customers of paid services without an applicable remedy.

6. Resource Allocation

The resources displayed on a Service page represent the resources allocated to that Service according to its plan.

Resources may include: • RAM. • vCPU. • Storage. • Bandwidth. • Network ports. • IP addresses. • Database storage. • Backup storage.

Customers must not attempt to circumvent resource limits through unauthorized virtualization, container manipulation, kernel modifications, process manipulation, or other technical methods.

CPU performance may vary depending on the underlying hardware, virtualization technology, workload, contention, and system conditions.

Advertised CPU models represent the infrastructure associated with the relevant Service and do not guarantee a specific benchmark score or continuous physical CPU frequency.

7. Fair Resource Usage

Customers must use resources in a reasonable manner.

Activities that intentionally interfere with the Infrastructure, degrade network performance, abuse shared resources, or negatively affect other customers may be restricted.

Examples include: • Excessive CPU consumption that materially impacts other customers. • Disk I/O abuse. • Network flooding. • Excessive packet generation. • Deliberate resource exhaustion. • Fork bombs. • Cryptocurrency mining where prohibited by the applicable Service. • Running uncontrolled processes that consume unreasonable resources. • Attempts to bypass resource limitations.

A high-resource workload is not automatically prohibited. The determining factor is whether the activity violates the applicable Service limits or materially impacts the Infrastructure or other customers.

8. Minecraft Hosting

Minecraft hosting customers are responsible for their Minecraft servers and all content installed on them.

You are responsible for: • Server configuration. • Plugins. • Mods. • Modpacks. • Worlds. • Player data. • Permissions. • Administrative access. • Server security. • Compliance with applicable Minecraft rules and licensing requirements.

Zenithz Cloud does not claim ownership of customer-created Minecraft worlds, configurations, or original content.

Customers must comply with the applicable rules and policies of Mojang/Microsoft and any third-party software used on their server.

Zenithz Cloud is not affiliated with, endorsed by, or officially connected to Mojang Studios or Microsoft unless explicitly stated otherwise.

9. Prohibited Activities

You may not use Zenithz Cloud Services for activities that violate applicable law or these Terms.

9.1 Network Abuse • DDoS attacks. • DoS attacks. • Network flooding. • Packet flooding. • Port scanning against unauthorized systems. • Unauthorized penetration testing. • Network disruption. • IP spoofing intended to facilitate abuse. • Attacks against third-party infrastructure.

Legitimate transactional or opt-in communications must comply with applicable laws and third-party provider policies.

10. Illegal Content

You may not use the Services to host, distribute, store, transmit, or facilitate illegal material or activities.

We may cooperate with lawful requests from government agencies, courts, law enforcement, network operators, or other authorized entities where legally required.

We may also take emergency action where necessary to protect our Infrastructure, customers, employees, or third parties.

12. Customer Content

You retain ownership of Content that you legally own.

By using the Services, you grant Zenithz Cloud the limited technical rights necessary to: • Store your Content. • Transmit your Content. • Process your Content. • Create temporary copies required to provide the Services. • Perform backups where applicable. • Provide technical support. • Maintain and secure the Infrastructure.

We do not obtain ownership of your Content merely because you store it on our Infrastructure.

You are responsible for maintaining appropriate backups of important data.

13. Backups

Unless explicitly included in your purchased Service, backups are not guaranteed.

Even where backups are offered, backups should not be treated as a substitute for independent customer backups.

Backups may fail due to: • Hardware failure. • Software errors. • Corruption. • Human error. • Security incidents. • Insufficient storage. • Infrastructure failures. • Customer deletion. • Configuration errors.

If a backup product is advertised with a specific retention period or frequency, that specification applies to that product.

We do not guarantee that every individual file, database, world, or configuration can be restored successfully.

14. Data Loss

Zenithz Cloud is not responsible for customer data loss except to the extent liability cannot lawfully be excluded.

Customers should maintain independent copies of important data.

Before performing major configuration changes, software updates, migrations, or destructive operations, customers should create their own backup.

15. Server Security

Customers are responsible for securing their servers.

This includes: • Keeping operating systems updated. • Updating plugins and applications. • Using strong passwords. • Restricting unnecessary ports. • Configuring firewalls. • Protecting SSH access. • Removing unnecessary software. • Monitoring suspicious activity. • Maintaining secure administrative credentials.

A compromised customer server may be temporarily isolated if it threatens our network or other systems.

16. DDoS and Network Protection

Zenithz Cloud may provide network-level DDoS mitigation depending on the Service and location.

DDoS protection does not guarantee that every attack will be completely mitigated.

Certain attacks may require temporary traffic filtering, null routing, IP replacement, service isolation, or other emergency measures.

We may temporarily suspend or isolate a Service when necessary to protect: • Our network. • Other customers. • Upstream providers. • Data center infrastructure. • Third-party networks.

17. IP Addresses

IP addresses assigned to customers remain under the control of Zenithz Cloud or the applicable upstream provider unless explicitly stated otherwise.

You do not acquire ownership of an IP address merely by being assigned or using it.

We may change or replace IP addresses when necessary due to: • Network changes. • Security incidents. • Abuse complaints. • Provider requirements. • Infrastructure migrations. • IP reputation problems. • Operational requirements.

We will attempt to provide reasonable notice where practical, but emergency changes may occur without prior notice.

18. Server Migration

We may migrate Services between physical or virtual infrastructure when necessary for: • Hardware maintenance. • Capacity management. • Infrastructure upgrades. • Network changes. • Security requirements. • Data center operations.

We will attempt to minimize downtime during planned migrations.

Scheduled maintenance will generally be announced where practical.

Emergency maintenance may occur without advance notice.

20. Uptime

We aim to maintain reliable Services but do not guarantee uninterrupted availability unless a specific Service Level Agreement ("SLA") applies.

Downtime may occur because of: • Hardware failure. • Network outages. • Upstream provider failures. • DDoS attacks. • Software failures. • Customer configuration. • Scheduled maintenance. • Emergency maintenance. • Datacenter incidents. • Force majeure events.

Unless explicitly included in a written SLA, uptime statements are targets rather than absolute guarantees.

21. Third-Party Services

Some Services may depend on third-party providers, including: • Datacenters. • Network carriers. • Payment processors. • DNS providers. • Cloud infrastructure. • Software developers. • Game publishers.

Third-party outages or policy changes may affect the Services.

Zenithz Cloud is not responsible for failures caused solely by third-party providers to the extent permitted by law.

22. Payments

Services must be paid for according to the pricing displayed at checkout or otherwise agreed upon.

You authorize Zenithz Cloud and its applicable payment providers to process payments associated with your purchases.

Prices may change for future billing periods.

Unless explicitly stated otherwise, a price change does not retroactively modify an already-paid billing period.

23. Taxes

Applicable taxes, duties, transaction fees, or government charges may be added where legally required.

Customers are responsible for providing accurate billing information.

Where required by law, Zenithz Cloud may collect and remit applicable taxes.

24. Failed Payments

If a payment fails or remains unpaid, we may: 1. Notify the customer. 2. Restrict certain Services. 3. Suspend the affected Service. 4. Terminate the Service after the applicable grace period.

Customers remain responsible for valid outstanding charges incurred before termination.

25. Service Suspension

We may suspend a Service when reasonably necessary due to: • Non-payment. • Security threats. • Abuse. • Illegal activity. • Terms violations. • Fraud. • Chargebacks. • Resource abuse. • Network attacks. • Compromised systems. • Requests from lawful authorities. • Threats to our Infrastructure or other customers.

Where practical, we may provide notice and an opportunity to resolve the issue.

However, immediate suspension may occur when delay could create significant security, legal, financial, or operational risk.

26. Account Termination

Either party may terminate a Service subject to the applicable billing and cancellation terms.

We may terminate an account for serious or repeated violations of these Terms.

Termination may result in deletion of associated Services and Content after the applicable retention period.

Customers are responsible for exporting required data before termination.

27. Abuse Investigations

We may investigate reports involving our Infrastructure.

Abuse reports may originate from: • Network operators. • Datacenters. • Security researchers. • Copyright holders. • Law enforcement. • Other customers. • Internet service providers. • Third-party security organizations.

We may request information or action from the customer.

Failure to respond to serious abuse reports may result in suspension or termination.

28. Chargebacks and Payment Disputes

Customers should contact Zenithz Cloud before initiating a payment dispute when the issue can reasonably be resolved through support.

Fraudulent or abusive chargebacks may result in: • Account suspension. • Service termination. • Restriction of future purchases. • Recovery of legitimate outstanding balances.

Nothing in this section prevents a customer from exercising rights provided by applicable law.

29. Refunds

Refund eligibility depends on the specific Service, product description, promotional terms, and applicable law.

Unless a specific refund policy states otherwise: • Used Services may not be eligible for a refund. • Setup fees may be non-refundable. • Add-on purchases may be non-refundable. • Dedicated resources may be non-refundable once provisioned. • Domain-related fees may be non-refundable. • Abuse-related termination does not automatically create a refund entitlement. • Fraudulent transactions are not eligible for refunds.

Where required by applicable consumer-protection law, those statutory rights take precedence over this section.

30. Promotions and Discounts

Promotional prices may have additional conditions.

We may impose reasonable restrictions on: • Number of purchases. • Duration. • Eligibility. • Renewal pricing. • Account age. • Payment method. • Product availability.

Promotional pricing may not automatically apply to renewals unless explicitly stated.

31. Fair Use of Support

Customers must communicate with support staff respectfully.

The following may result in support restrictions: • Threats. • Harassment. • Abuse. • Spam. • Repeated tickets for the same issue. • Deliberately misleading information. • Attempts to manipulate support staff. • Excessive automated requests.

Technical disagreement does not constitute misconduct. Customers may challenge decisions through the appropriate escalation process.

32. Control Panel Access

Where a web control panel is provided, customers are responsible for activities performed through their panel account.

Control panel features may include: • Server management. • Console access. • File management. • Backups. • Databases. • Network configuration. • User management. • Logs. • Remote access.

Features may differ depending on the Service.

We may restrict dangerous administrative functions when necessary to protect the Infrastructure.

33. SSH and Remote Access

Where SSH or equivalent remote access is provided, customers are responsible for securing credentials and software.

You must not use remote access to conduct unauthorized attacks or abuse.

We may temporarily restrict remote access where necessary to investigate a security incident.

34. VNC and Console Access

Where VNC, serial console, browser console, or similar functionality is provided, customers must use it only for legitimate administration of their own Service.

You must not use these systems to attempt unauthorized access to other systems.

35. Software Licensing

Customers are responsible for obtaining and maintaining licenses for software they install.

This includes: • Operating systems. • Plugins. • Mods. • Commercial software. • Databases. • Control panels. • Game software. • Proprietary applications.

Zenithz Cloud does not provide licenses merely by providing server infrastructure.

36. Cryptocurrency and Mining

Cryptocurrency mining may be restricted or prohibited depending on the Service, hardware, location, provider requirements, or resource impact.

Customers must not assume that mining is permitted merely because a server technically supports it.

Where mining is permitted, it must comply with the applicable Service limits and all applicable laws.

Zenithz Cloud may restrict mining workloads that materially interfere with Infrastructure or violate provider policies.

37. Proxy and VPN Services

VPN, proxy, tunneling, relay, and similar services may be permitted only where they comply with these Terms and applicable provider policies.

Operating services intended to facilitate fraud, spam, abuse, credential theft, unauthorized access, or malicious traffic is prohibited.

We may restrict proxy or relay services that generate abnormal network traffic or abuse complaints.

38. Server Reselling

Customers may not resell or redistribute Services unless the purchased product or a separate agreement explicitly permits it.

Unauthorized reselling includes: • Subleasing VPS resources. • Creating unauthorized hosting panels. • Selling access to allocated infrastructure. • Redistributing IP addresses. • Providing third-party hosting from a non-reseller Service.

Approved reseller programs may have separate terms.

39. Security Research

Legitimate security research may be permitted when: • You own the target system. • You have explicit authorization. • Testing does not disrupt our Infrastructure. • Testing does not affect other customers. • Testing does not involve data theft. • Testing does not involve destructive activity.

Testing against Zenithz Cloud Infrastructure without authorization is prohibited.

40. Vulnerability Disclosure

If you discover a security vulnerability affecting Zenithz Cloud, report it responsibly through our designated security contact.

Do not publicly disclose sensitive vulnerability details before we have had a reasonable opportunity to investigate and mitigate the issue.

We do not guarantee monetary rewards for vulnerability reports unless a separate program explicitly provides them.

41. Privacy

Your use of the Services may involve the processing of personal information.

Information may include: • Account information. • Billing information. • Authentication information. • IP addresses. • Service logs. • Security logs. • Support communications. • Technical information.

The handling of personal information is governed by our applicable Privacy Policy.

These may include: • Authentication events. • Network metadata. • Server events. • Security events. • API activity. • Control panel activity. • System logs.

We may use these records to investigate security incidents, abuse reports, fraud, and service reliability issues, subject to applicable law.

43. Data Requests

Where legally required, we may respond to valid legal requests for information.

We may also preserve relevant information where legally required or reasonably necessary for investigating security incidents, fraud, abuse, disputes, or violations of these Terms.

44. Intellectual Property of Zenithz Cloud

The Zenithz Cloud name, branding, website design, software, documentation, logos, graphics, and proprietary systems may be protected by intellectual-property laws.

You may not copy, modify, redistribute, reverse engineer, or commercially exploit our proprietary materials without permission, except where such restriction is prohibited by applicable law.

45. Third-Party Software

Some Services may include open-source or third-party software.

Such software may be governed by its own license terms.

Where a third-party license conflicts with these Terms regarding the licensed software itself, the applicable third-party license may control to the extent required.

46. Beta and Experimental Services

Beta, preview, experimental, or development Services may be provided without the same reliability guarantees as production Services.

Such Services may: • Change without notice. • Experience downtime. • Lose data. • Be discontinued. • Have incomplete features.

Customers should not use experimental Services for critical workloads unless they accept these risks.

47. Service Changes

We may modify technical specifications, infrastructure, software, control panels, locations, or features when necessary.

Where a material change negatively affects a prepaid Service, we will attempt to provide a reasonable alternative or other remedy where appropriate and legally required.

48. Force Majeure

Zenithz Cloud is not responsible for delays or failures caused by events outside our reasonable control.

Examples include: • Natural disasters. • Fires. • Floods. • Earthquakes. • War. • Civil unrest. • Government actions. • Major Internet outages. • Datacenter failures. • Upstream provider failures. • Power-grid failures. • Telecommunications failures. • Large-scale cyberattacks. • Pandemics. • Hardware supply disruptions.

49. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Services are provided on an "as available" basis.

We do not guarantee that: • Services will always be available. • Services will be completely error-free. • Every workload will perform identically. • Every third-party application will function correctly. • Backups will always succeed. • Data can always be recovered. • Network routes will remain unchanged. • Hardware will never fail.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

50. Limitation of Liability

To the maximum extent permitted by applicable law, Zenithz Cloud will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Services.

This may include: • Lost profits. • Lost revenue. • Lost business opportunities. • Lost data. • Business interruption. • Loss of reputation. • Loss of anticipated savings.

Where permitted by law, Zenithz Cloud's aggregate liability relating to a Service will be limited to the amount paid by the customer for that affected Service during the applicable period specified by applicable law or agreement.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

51. Customer Indemnification

To the extent permitted by law, you agree to defend and indemnify Zenithz Cloud, its operators, employees, contractors, and service providers against claims, damages, liabilities, and reasonable expenses arising from: • Your unlawful use of the Services. • Your violation of these Terms. • Your Content. • Your infringement of third-party rights. • Your abuse of the Infrastructure. • Your unauthorized actions.

This section does not require you to indemnify us for liability caused solely by our own unlawful conduct where such indemnification would not be legally enforceable.

52. Notices

We may communicate with customers through: • Email. • The customer dashboard. • Control panel notifications. • Service announcements. • Support tickets. • Other contact methods associated with the account.

You are responsible for maintaining a valid email address and checking important account communications.

53. Changes to These Terms

We may update these Terms from time to time.

The updated version will become effective when published unless a different effective date is stated.

Material changes may be communicated through appropriate channels where required.

Continued use of the Services after the effective date constitutes acceptance of the updated Terms to the extent permitted by law.

54. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue to apply.

The invalid provision will be interpreted or modified to the minimum extent necessary to make it enforceable where legally permitted.

55. No Waiver

Failure to enforce any provision of these Terms does not constitute a permanent waiver of our right to enforce that provision later.

56. Assignment

You may not transfer your account or contractual rights to another party without our prior approval where such approval is required.

We may transfer or assign our rights and obligations as part of a merger, acquisition, restructuring, sale of assets, or similar transaction.

57. Entire Agreement

These Terms, together with applicable product-specific terms, refund policies, privacy policies, service agreements, and other explicitly incorporated documents, constitute the agreement governing your use of the Services.

If there is a conflict between documents, the more specific Service agreement will generally control for that Service unless applicable law requires otherwise.

58. Governing Law

These Terms will be interpreted according to the laws applicable to the legal entity operating Zenithz Cloud and the jurisdiction in which that entity is established, subject to mandatory consumer-protection and other applicable laws.

Nothing in this section removes rights that customers are legally entitled to exercise under mandatory laws applicable to them.

59. Dispute Resolution

Customers should first contact Zenithz Cloud support to attempt to resolve disputes informally.

If a dispute cannot be resolved through support, the parties may pursue the remedies available under applicable law.

Nothing in these Terms prevents a consumer from exercising mandatory statutory rights.

60. Abuse Reporting

Abuse reports should include sufficient information for us to investigate the alleged violation.

Useful information may include: • Affected IP address. • Timestamp. • Destination. • Type of abuse. • Relevant logs. • Evidence of the violation. • Contact information for follow-up.

False or intentionally misleading abuse reports may themselves constitute abuse.

61. Customer Responsibility

You are ultimately responsible for everything executed, stored, transmitted, or hosted through your Services.

Purchasing a server does not transfer legal responsibility for its use to Zenithz Cloud.

You should regularly review: • Running processes. • User accounts. • SSH keys. • Firewall rules. • Open ports. • Installed software. • Plugins. • Server logs. • Network activity.

62. Termination Data Retention

After Service termination, customer data may be deleted after a reasonable retention period.

The exact retention period may vary based on: • Product type. • Storage requirements. • Legal obligations. • Security requirements. • Operational limitations.

Once deleted, data may not be recoverable.

Customers should export their data before cancellation or termination.

63. Dormant Accounts

We may restrict or terminate accounts that remain inactive for an extended period where they create security, operational, or administrative concerns.

Where practical, reasonable notice may be provided before deletion.

64. Abuse of Promotions

Customers must not create multiple accounts or manipulate billing systems solely to circumvent: • Promotional limits. • New-customer restrictions. • Payment restrictions. • Resource limits. • Account restrictions.

Promotional abuse may result in cancellation of promotional benefits or account suspension.

65. Fraud Prevention

We may perform automated or manual checks to detect fraudulent transactions and abuse.

These checks may consider: • Payment information. • Account history. • IP reputation. • Device or browser signals. • Order patterns. • Previous abuse records.

A transaction may be delayed, rejected, or manually reviewed when fraud indicators are detected.

66. Service-Specific Terms

Certain Services may have additional requirements.

Examples include: • VPS-specific resource policies. • Dedicated server policies. • Game-specific rules. • Reseller agreements. • Backup policies. • DDoS protection policies. • Promotional terms.

Where additional terms apply, they form part of the agreement for that Service.

67. Acceptance
